General Terms and Conditions


§ 1 Scope, customer information


The following general terms and conditions regulate the contractual relationship between SMtec GmbH and consumers and entrepreneurs who purchase goods through our shop. We do not accept any terms and conditions that conflict with or deviate from our terms and conditions. The contractual language is German.


§ 2 Conclusion of contract


(1) The offers on the Internet represent a binding offer to you to purchase goods.

(2) After entering your data and clicking the order button, you accept this offer to conclude a purchase contract. You can also conclude the purchase contract by telephone.


§ 3 Customer information: Storage of your order data


Your order with details of the concluded contract (e.g. type of product, price, etc.) is stored by us. We will send you the general terms and conditions, but you can also access the general terms and conditions at any time after the contract has been concluded via our website.

As a registered customer, you can access your past orders via the customer login area (my user account).


§ 4 Customer information: Correction notice


You can correct your entries at any time before placing the order using the delete key. We will inform you about further correction options as you go through the ordering process. You can also end the ordering process completely at any time by closing the browser window.


§ 5 Return costs in the event of cancellation


In the event of cancellation, you must bear the costs of return if the goods delivered correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the item, you have not yet paid the consideration or a contractually agreed partial payment at the time of cancellation. You only have to bear the regular costs of return. Additional costs that arise, for example, due to a change in our place of business or due to the use of expensive transport services requested by us, are at our expense.


§ 6 Limitation of your warranty claims


(1) Warranty for consumers for used goods
Your claims for defects in used goods expire one year after the item sold is handed over to you. Excluded from this regulation are claims for damages, claims for defects that we have fraudulently concealed, and claims arising from a guarantee that we have given for the quality of the item. The statutory limitation periods apply to these excluded claims.

(2) Warranty for entrepreneurs
Your warranty claims for defects in the purchased item expire one year after the transfer of risk. Excluded from this regulation are claims for damages, claims for defects that we have fraudulently concealed, and claims arising from a guarantee that we have given for the quality of the item. The right of recourse under Section 478 of the German Civil Code is also excluded. The statutory limitation periods apply to these excluded claims.


§ 7 Limitation of Liability


We exclude liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damages resulting from injury to life, body or health, guarantees or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include in particular the obligation to hand over the item to you and to give you ownership of it. Furthermore, we must provide you with the item free of material and legal defects.
